General Conditions of the Mountain Service
- Your Pass and associated Proximity Card are issued in your name and are nontransferable and nonrefundable. The Pass can only be used by the cardholder to whom it was issued. Improper use of the Pass authorizes Cerro Bayo S.A. to seize and/or revoke the Pass immediately. In this case, the contract through which the user acquired the Pass will be canceled, by operation of the law and without the need for any notification. In this case, the user will lose any right to claim damages. In the case that the Pass is used by third parties (persons other than the cardholder), who are or are not part of their family group, to access the lifts, the pass will be seized immediately, and the offending user will not be able to use the service again and will not be entitled to make any claims.
- The term "ski" used in these General Conditions also refers to and includes snowboarding and its variants.
- The provision of the Proximity Card to third parties or its adulteration or falsification constitutes a crime as established in Articles 172 and 173 of the Criminal Code.
- The holder of the Proximity Card has the duty to care for it. Cerro Bayo S.A. is not responsible for the robbery, theft, deterioration and/or loss of the Proximity Card. In any of the above mentioned cases of robbery, theft, deterioration and/or loss, if the user intends to access the lifts, they must purchase another Proximity Card at the current sale price. In all cases, there will be an additional cost for reissuing the Card.
- The Proximity Card has a shelf life and no replacement insurance is available. It is mandatory in all the ski Passes.
- Passes for voluntarily unused services and/or for services that were unused due to weather conditions cannot be returned.
- Purchasing passes implies that the user will respect the lift lines and wait their turn.
- Cerro Bayo S.A. reserves the right to admit users and remove them from the premises.
- The Pass is only valid for riding the lifts of Cerro Bayo S.A. during the stipulated period of time. The failure to use the Pass and/or the closure of a lift during the season implies the loss of the Pass and it value; therefore, the Pass cannot be used in subsequent seasons.
- The staff of Cerro Bayo S.A. may, at any time, require the user to show the Pass, payment receipt and documents that verify the identify of the cardholder.
- The staff of Cerro Bayo S.A. may, at their sole discretion, annul and/or seize the Pass at any time and in any place, if the user engages in misconduct, including any conduct that endangers their own physical wellbeing, that of other people or the property belonging to the company and/or its concessionaires, and/or if user does not respect the rules established in Decree 917/2015 of the Province of Neuquén, which can be found in the Customer Service Office of Cerro Bayo S.A. and on our website www.cerrobayo.com.ar.
- The user accepts and agrees to comply with the obligations established in Decree 917/2015 of the Province of Neuquén, which can be found in the Customer Service Office of Cerro Bayo S.A. In addition, the user takes responsibility for the consequences of their failure to comply with the provisions of the above mentioned regulation.
- The user understands that they are responsible for the safe use of the lifts. The user also understands that they are responsible for controlling their speed, direction and posture and that they are responsible for determining whether they have the ability level required to use different lifts, trails and routes. The user is hereby informed that there are inherent risks associated with skiing and other risks associated with mountain sports. These risks include, but are not limited to: variations in the snow, wind, visibility, trails and terrain, ice, icy conditions, rocks, avalanches, trees and other woody plants that grow above and below the surface, lift towers, delimiting ropes, snow-making equipment and other natural and man-made obstacles on and/or off of the designated trails and/or the equipment that they use to get around and/or the elements they carry. The user is hereby informed that they may also have collisions with fixed or mobile equipment and/or collisions with third parties that do not generate any kind of liability for Cerro Bayo S.A. The user is hereby informed that the conditions of the delimited trails vary due to weather conditions and use. If the user does not agree that the sometimes severe harm resulting from these risks are not the liability of Cerro Bayo S.A., and does not agree that they are voluntarily assuming these risks and harms while practicing this sport, they should not buy the Pass. By purchasing the pass, the user assumes all personal risks, material risks and harms to third parties inherent in skiing and other related mountain sports, which they recognize as inherently risky activities.
- The user is hereby informed that they must respect the signs, instructions and warnings on the trails and lifts that are duly communicated through signs and by the company's staff.
- Users under the age of 14 must wear a helmet when on the trails, in accordance with provision 376/10 of the Provincial Directorate of Concessions of the Province of Neuquén.
- Users who have different needs or a disability must enter the ski center with a responsible companion. In addition, these users or their companions may inform Cerro Bayo S.A., in advance, of the possible need for additional assistance. Users with disabilities must access the lifts with their respective companions, who must assume responsibility for the disabled person by signing the corresponding description of responsibility. The responsible companion must purchase the pass corresponding to the services they plan to use.
- In addition, the only ski trails that disabled and/or adaptive skiers are allowed on are the green and blue trails that correspond to the lift that they rode. As an exception, expert adaptive skiers can use the red trails on the above mentioned lifts. The black trails are off limits for adaptive skiers. The use of the safety band or strap is required to fasten the chair to the lift.
- For the user's safety only, the leader or members of the ski patrol may limit access to the lifts based on the technical skill demonstrated by the user.
- The user's equipment must have the safety features needed to practice the sport and/or use the lifts; this means that it is warm enough, on all parts of the body, to resist low temperatures and stay outside for 3 to 5 hours longer than intended, in the case of problems with the lift. If the equipment does not meet these conditions, Cerro Bayo S.A. is not liable for the consequences that may result from the failure of said elements.
- The partial, sectoral or total shutdown of the lifts for any reason, including weather and/or safety and/or technical conditions, does not entitle the user to make claims of any kind.
- Due to weather conditions, a lift may be operated "conditionally"; this means that, for your safety, the lift may be closed at any time or be stopped for an unspecified time, and may be stopped completely and require evacuation with harnesses and/or safety elements. Cerro Bayo S.A. has the right to prohibit children on lifts that are operated "conditionally". In the case that passes are purchased when the weather conditions are "conditional", and this is stated on the receipt, web page and/or ticket offices, the user will not be entitled to any claim or refund.
- The cost of the rescues performed by the ski patrol staff outside the authorized trails and in the backcountry areas and/or of people who violate the general service conditions and/or violate the hours set by Cerro Bayo S.A. for the use of the lifts, will be covered exclusively by the user. The cost of rescue per person will be, at least, equal to the sum in pesos of a adult's week-long pass in the high season. The cost of rescue may be higher, depending on the nature of the rescue.
- The equipment used to move around on the trails at Cerro Bayo must include an automatic stopping system (stoppers) in good condition in order to avoid accidental slipping or a leash that must be attached to the leg, arm or waist of the user at all times, even when using a lift. In the case of using a leash, if the equipment is left by the user in any area above the base, it must be fastened to a firm railing or post.
- Admission to the daycare is subject to the general conditions, availability and service hours.
- Pregnancy increases the risks associated with skiing and any other mountain sport, as well as with elevated and surface lifts. By purchasing a pass, the user acknowledges and accepts the increased risk that comes with using the elevated lifts.
- In order to ride the lift up with equipment other than skis or a snowboard (for example, with snowmotos, snowbikes, etc.) the user must request express authorization in advance at the Customer Service Office of Cerro Bayo S.A.
- Pedestrians are prohibited from riding the elevated lifts, with the exception of the Telecabina Jean Pierre (Jean Pierre Gondola), Telesilla Principal (Main Chairlift), Telesilla Chalten (Chalten Chairlift) and Telesilla Panorámica (Panoramic Chairlift), whose use is described in the notes.
- Users are prohibited from riding the lifts with paragliding equipment.
- For the application of reduced prices, discounts and/or promotions, Cerro Bayo S.A. reserves the right to request the presentation of the corresponding documentary proof at any time and throughout the season. Failure to provide the requested documentation will result in the automatic annulment of the pass, without any right to protest.
